The Temporary Regulations of Welfare Mutual Aid of Public Representatives at Different Levels and Village Heads of Taiwan Province
Chapter I General Provisions
Article 1 This Regulation is enacted to temporarily handle the welfare mutual aid of public representatives at different levels and village heads of Taiwan Province (hereinafter called “Welfare Mutual Aid”).
Article 2 The term “public representatives at different levels” used in this Regulation means county/city councilors and township/city representatives.
Article 3

The Ministry of the Interior (hereinafter called “Interior”) may set up a committee of the welfare mutual aid of public representatives at different levels and village heads of Taiwan Province (hereinafter called “Committee”) to handle welfare mutual aid affairs of this Regulation, fundamentals of the Committee shall be formulated by the Interior.

Article 4 Welfare mutual aid of public representatives at different levels of Taiwan Province shall use the county/city council and the township/city council as participative mutual authorities, and administrative agencies of each council are sponsors. Welfare mutual aid of village heads shall use the township/city/district office as participative mutual authorities, and a civil affairs section of each office are sponsors.

Chapter II Mutual Helpers and Beneficiary

Article 5 Public representatives at different levels and village heads of Taiwan Province are mutual helpers during their positions.
Article 6 Apart from funeral mutual aid benefits of the mutual helper himself, the term “beneficiary” used in    this Regulation all means the mutual helper himself.
Article 7 The following shall be determined as the beneficiary of funeral mutual aid of the mutual helper himself in order:
  1. Spouse
  2. Children
  3. Parents
  4. Brothers and Sisters
  5. Grandparents
"Children" as referred to in subparagraph 2 of the preceding paragraph are under age, their guardian may replace the minor to withdraw mutual aid allowance.
Article 8 No beneficiary in the preceding article withdraws the funeral mutual aid allowance of the mutual helper himself shall be carried out in accordance with the following orders:
  1. A person appointed by the mutual helper before the latter's death
  2. Participative mutual authorities
Chapter III Participation, Exit and Interruption of Mutual Aid
Article 9 Participative mutual aid authorities shall make registers of public representatives at different levels and village heads of Taiwan Province as well as deliver mutual information forms to the Committee. The Committee shall handle participative procedures at one time.
The monthly officers newly appointed shall be carried out in accordance with the proceeding paragraph.
Article 10 When public representatives at different levels and village heads of Taiwan Province newly appointed, is dismissed, or dies, their participation or exit shall take effect on the day of taking office, is removed from office, or in the event of death. Provided, however, that the monthly mutual aid allowance shall be withhold in accordance with the whole month.
Article 11 Mutual helpers suspended from office or drafted to military service shall be carried out in accordance with the following provisions:
  1. Suspended from office means interruption of mutual aid. When the cause for such interruption ceases, mutual helpers shall be allowed to resume office and their rights and obligations shall be  deemed to continue existence. The mutual expense shall be repaid and the mutual aid allowance shall be reissued for the duration of the suspension. Provided, however, that mutual helpers suspended from office shall exit mutual aid from the date of suspension.
  2. For the duration of military service, mutual helpers shall be deemed to continuous participation and their mutual expense shall be paid by annual budget of participative mutual authorities.
Article 12 When mutual helpers exit or interrupt form mutual aid, the paid mutual expense shall not be returned whether mutual helpers have withdrawn the mutual aid allowance during the mutual aid or not.
Article 13 Sponsors of participative mutual authorities shall make a monthly report of mutual helpers whose records of participation, exit or interruption for each month and submit to the Committee.
Chapter VI Raise, Custody and Exercise of Mutual Aid Expense
Article 14

The following ways of raising and defray welfare mutual aid expense are:

  1. Government’s subsidies: Each mutual helper has one hundred and fifty (NT$ 150) dollars for each month. The Interior competent on such issues shall formulate budget and appropriate funds to the Committee for custody and exercise.
  2. Mutual helpers’ onus: Each mutual helper shall pay fifty (NT$ 50) dollars for each month. Sponsors of participative mutual authorities shall list and inform cashier and accounting agencies to deduct expense from the salary of mutual helpers every month prior to the tenth of current month, defray the Committee’s special accounts of banks and make a calculation of mutual expense and submit to the Committee.
Article 15 Accounting agencies of participative mutual authorities shall compile a revenue and expense statement of mutual expense for two copies, one is to keep in the files for future reference and the other shall submit to sponsors, together with monthly alteration report, applications and information forms and submit to the Committee prior to the fifth of next month.
Article 16 The Committee shall deposit and keep welfare mutual aid expense in the special accounts of banks or purchase and deposit bonds and debentures issued by the government appropriated from welfare mutual aid expense. The principal and produced profits shall be used as welfare mutual aid.
Chapter V Mutual Items and Mutual Payment Standard
Article 17 The following are welfare mutual aid items:
  1. Mutual aid of seriously injury/disease and hospitalization
  2. Mutual aid of disability
  3. Mutual aid of funeral and burial
Article 18 The following are welfare mutual aid payment standards:
  1. Mutual aid of seriously injury/disease and hospitalization:
    The mutual helper himself shall be paid seventy percent (70%) of medical expense and his   parents, spouse and maintained children shall be paid fifty percent (50%) of medical expense. Provided that, the amount of payment of mutual helper and his family dependants shall not be paid more than thirty thousand (NT$ 30,000) dollars of each fiscal year.
  2. Mutual aid of disability:
    If the mutual helper himself is permanently disabled, the payment is thirty-five thousand (NT$  35,000) dollars; half disabled, the payment is twenty-five thousand (NT$ 25,000) dollars; partly disabled, the payment is fifteen thousand (NT$ 15,000) dollars.
  3. Mutual aid of funeral and burial:
    If the mutual helper himself died, the payment is eighty thousand (NT$ 80,000) dollars; his parents or spouse died; the payment is twenty thousand (NT$ 20,000) dollars, his maintained children died, the payment is ten thousand (NT$ 10,000) dollars.
    "Maintained children" as referred to in subparagraph 1 and 2 of the preceding paragraph are not reaching their twentieth year of age, or reaching their twentieth year of age and is proved a student by a school, or is proved physically or mentally disabled who are not able to live by themselves rely on the mutual helper in maintaining.

Chapter VI Application subsidies and limitation

Article 19 When applying for each mutual aid allowance, the beneficiary shall fill in an application for two copies, together with relevant certifications, submit to the sponsor for examination. If true, report to the Committee for examination and allocation.
Article 20 The patient who have seriously injury/disease shall be hospitalized in the public medical institutions or private medical institutions appointed by national health insurance institutions.
Car accident, operation of acute disease, cerebral haemorrhage and other seriously injury or disease, if not rescued or cured immediately by the nearly non-designated medical institutions appointed by the Bureau of Central Health Insurance is not able to save life, medical expense of rescue shall be paid within seven days. If the patient’s condition is very serious and rescued more than seven days may be audited and offered to the Committee as a special case.
Article 21 Mutual aid allowance of seriously injury/disease and hospitalization shall be limited under the secondary sickrooms. If the expense and meals, designated doctors, special nursing, air conditioning/heating machine, companion, assistant of doctors, diagnosis, registration fee and other expense exceed the secondary sickrooms, the mutual helper shall burden all expenses by himself.
Apart from significant operations and trauma and other serious tissue detriment, or loss of blood put your life in danger, the mutual helper shall burden blood transfusion expense by himself.
Article 22 In any of the following circumstances, the mutual helper or his dependants may not apply mutual aid allowance of seriously injury/disease and hospitalization:
  1. Plastic surgery, cosmetic surgery, suicide and operation of not injury/disease.
  2. Have accepted free medical treatment or other relevant subsidies.
  3. The injury or disease is caused by misconducts.
  4. Where a patient is disabled due to injury or disease and has received the payment for disability, he may not apply for treatment for the same injury or disease.
Article 23 Disabled Time shall be offered in accordance with the following provisions:
  1. While healing over a wound or loosing plaster cast, the disease has been healed.
  2. After healing over a wound, loosing plaster cast or being healed the disease, within specified time, the determination date is when he is diagnosed as the disabled.
  3. The same injury or disease has been healed.
Article 24 The term “disability” of this Regulations shall be determined in accordance with the table of the standard for disability payment of the civil servants health insurance.
Article 25 Brothers and sisters are mutual helpers or attend mutual aid at departments or schools, if their parents have mutual aid accidents, the application of mutual aid allowance shall be limited to one of brothers and sisters.
Husband and wife are mutual helpers or a party attends mutual aid at departments or schools, if their spouse, the person himself or their maintained children have mutual accidents, the application of mutual aid allowance shall be limited to one of husband and wife.
Children and parents are mutual helpers or attend mutual aid at departments or schools, if their parents or the person himself has mutual aid accidents, the application of mutual aid allowance shall be limited to one of children and parents.
Article 26 The spouse, children, parents of mutual helpers have mutual aid accidents, without household registration of the Republic of China, shall not be paid mutual aid allowance.
Article 27 Each mutual aid allowance shall be applied within six months from the next day of the accident took place, within the postponed time limit, a person loses his rights. The application of mutual aid allowance of seriously injury/disease and hospitalization shall be commencing from the next day after leaving the hospital; if the accident took place during suspension due to case, the mutual aid allowance shall be reissued within six months from the next day of being allowed to resume office.
Article 28 The beneficiary of each mutual aid allowance, take mutual aid allowance by posing as someone else of whom it is intended, repeatedly claim, fabricate, or alter certificates, if any, the mutual aid allowance shall be received according to law.

Chapter VII Supplementary Provisions

Article 29 The formats of all the letters, tables, and forms of this Regulations shall be determined by the Committee.
Article 30 This Regulations shall become effective as of July 1, 1999
